About these terms
These terms apply when you use the KIVO apps, kivofit.app and the KIVO trainer portal (“KIVO”). By creating an account or using KIVO you agree to them and to our privacy policy. If you download KIVO from the App Store, Apple’s standard licence agreement also applies; if anything here conflicts with it, Apple’s agreement wins for the iOS app.
Your account
- You must be at least 13 years old, and old enough to agree to these terms where you live.
- Give accurate details and keep your sign-in safe. You are responsible for activity on your account.
- An account works on one phone at a time; signing in on a new phone signs the old one out.
- You can delete your account at any time in Profile → Settings → Delete account.
Price
KIVO is currently free. If we ever add paid features, we will show the price and terms clearly before you buy, and purchases in the iOS app will go through Apple.
Training safely
KIVO helps you log workouts and suggests weights based on what you lifted before. It is not a medical device and does not give medical advice. It doesn’t know about injuries, illness or your technique. Talk to a doctor before starting a new training programme, especially if you have a health condition or are pregnant. Warm up, use a spotter for heavy lifts, and stop if something hurts. You train at your own risk.
Your content
Your workouts, measurements and the exercises and routines you create stay yours. You allow us to store and process them to run KIVO for you, as described in the privacy policy. If you suggest an exercise or routine for the KIVO library, you allow us to edit it and publish it for everyone, without your name.
Trainers
If you link a trainer, you choose to share your training with them until you unlink. Trainers are independent professionals, not KIVO staff, and KIVO is not responsible for their advice. If you use the trainer portal as a trainer, you agree to:
- use clients’ data only to coach those clients, keep it confidential, and not copy it out of KIVO for other purposes;
- be qualified for the coaching you offer and follow the laws that apply to you;
- keep messages professional and respectful.
We may pause or remove a trainer account that breaks these rules.
Acceptable use
Don’t upload or send anything illegal, harassing, hateful, sexual or misleading; don’t impersonate anyone; and don’t try to break, overload, scrape or get around the security of the apps or servers. You can report abuse to [email protected], and we act on reports promptly.
The service
We work to keep KIVO running and your data safe, but we can’t promise it will always be available or free of mistakes. We may change, add or remove features. If we ever shut KIVO down, we will give you notice and a way to export your workouts.
Liability
To the extent the law allows, KIVO is provided “as is”, and we are not liable for indirect or consequential losses, lost data beyond our reasonable control, or injuries from training. Nothing in these terms limits rights you have under consumer law that can’t be limited.
Ending
You can stop using KIVO and delete your account at any time. We may suspend or close an account that breaks these terms, and will tell you why unless the law prevents it.
Law
These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without taking away protections you have under the laws of the country where you live.
